Khadija demands 29000AZN from the state
Jailed journalist Khadija Ismayil demanding compensation from the government of Azerbaijan for illegal detention. She has sent a written statement to the Ministry of Finance.
Khadija was arrested December 5, 2014 on charges of incitement to attempt suicide. She was sentenced to two months in pretrial detention. Despite the appeal to dismiss this decision, the court decided to keep Khadija locked up.
On January 27, 2015 the same court ruled to extend Khadija's administrative detention until March 24.
On February 13, Khadija received additional charges- appropriation, illegal entrepreneurship, and tax evasion. This time a different court ruled to extend Khadija's detention by another two months until May 24.
On September 1, 2015, Khadija Ismayil was sentenced to 7.5years in jail on charges of appropriation, illegal entrepreneurship, and tax evasion while she was acquitted of the suicide charge.
Now Khadija demands compensation for the unlawful detention time she spent in jail based on article 125 of the Criminal code (suicide attempt).
In an interview with AzadliqRadiosu, lawyer Yalchin Imanov said as acquitted person Khadija has the right to demand compensation especially when there is proof as in court decision that the time she spent in detention-91 days- between December 5 and March 6 was unsubstantiated.
She is demanding 9,030AZN in compensation for the time she spent unable to work and deliver stories and therefore unable to generate income; costs of lawyers; and money spent by her family on food parcels during her detention. In addition, Khadija demands 20,000AZN for moral damages.
